I'm not sure if I understand all the details here but why all this talk about P96 and CGFX? I thought new drivers had to be made from "scratch" to suit the new hardware directly? What if someone wants to make a game or a demo that depends on the new and improved video/resolution modes? What if these people want their work independent of the Operating System? Is this only possible to do if one uses the old video/resolution modes?

Isn't there a huge difference between "native" support and "OS" support?

  Please see above - truecolor is not possible with a native monitor driver, but requires patching Gfx, i.e. a P96 driver. Unfortunately, the copyright situation is rather complicated here as well.
 

Implementing something P96 compatible with sources or inspiration from AROS should be doable though, without any copyright problems.

New drivers had been made to fit the needs for 8 plane planar access. No support for chunky for the reasons already mentioned, no support for truecolor for this very reason.

I think AROS is already CGX 3 compatible, as are P96 and CGX 4.  Where they diverge is on hardware overlays, which aren't supported in SuperAGA at this point anyway.  (Maybe sometime in the future.)
